General Terms and Conditions
General
Sportalm GmbH Kitzbühel, St. Johanner Str. 73, A-6370 Kitzbühel (hereafter referred to as “Sportalm”) sells fashion products by sportalm via the company-owned onlineshop www.sportalm.at. All orders, transactions and in particular the resultant deliveries of Sportalm merchandise are subject to the following general terms and conditions. Any agreement deviating from these terms and conditions must be proposed in writing and accepted by Sportalm Kitzbühel in written form. Furthermore the terms and conditions apply only to offers, transactions and miscellaneous services in dealing with end consumers (hereafter referred to as “customers”) in accordance with the Austrian Consumers Protection Act (KSchG).
Austrian Law will apply to all closed agreements, respectively contracts between Sportalm and the customer. Sportalm hereby explicitly waives the UN Convention on Contracts for the International Sale of Goods. The terms and conditions are accepted in the course of the order transaction through clicking the field “I accept your general terms and conditions” and through the sending of a completed order form by the customer. These terms and conditions are accessible to the customer at any time on the website www.sportalm.at.
Online shop orders, contracts, delivery and service
Customer orders with Sportalm are binding from the moment Sportalm receives the order until completion of the contract. The customer will receive an automatic order confirmation notifictation which does not yet constitute an acceptance of the offer. A contract first comes into effect upon delivery of the customer’s order by Sportalm or when a contract confirmation is sent in written form. The acceptance of the order remains subject to availability. Sportalm may reject a customer oder on specific grounds (eg outstanding account on already shipped orders). In the case that Sportalm is unable to execute the order, the customer will be informed immediately. Sportalm does not guarantee the completeness, up-to-dateness or accuracy of the information depicted in the online shop (eg colours and price descriptions). Sportalm has exhausted all possibilities to ensure that the colours of the depicted designs are as faithful to the original as possible. Colour display is dependent upon the quality of computer used by the customer. On this ground, Sportalm is unable to guarantee that the colours displayed on the website or in the online shop match the real colours of the models. At the discretion of Sportalm, subsequent requests for change by the customer will be taken into consideration. A suitable reimbursment of costs may apply.
Prices and Shipping Costs
All prices displayed in the online shop are Euro sums and include the statutaory value-added tax (Mehrwertsteuer – MWST) ) The delivery costs are 7 € in Austria and 11 € in Germany until further notice.
Method of Payment
At the current time, Sportalm only accepts credit card payments with MasterCard and Visa. The goods remain the property of Sportalm until payment in full has been made.
Delivery, Shipment and Insurance
Shipping is provided via GLS. Shipping times are within Austria (1-4 days) and Germany (3-5 days). These shipping times serve as a guideline from the time of delivery. Articles will only be delivered in quantities usual for households. Delivery takes place Monday to Friday from 9am – 5pm. The ordered goods are insured by Sportalm throughout the delivery time until the delivery is taken by the customer.
Warranty
In the event that the delivered article displays evidence of obvious material or manufacturing defects, Sportalm must be informed immediately in writing: via email: support@onlineshop.at or per post: Sportalm GesmbH, St Johanner Str. 73, A-6370, Kitzbühel
Right to Return/Cancellation
In accordance with § 5e KSchG (Consumers Protection Act) the customer has the right to opt out of the sales contract in written form (eg. email, letter)
without giving reasons within 14 days. The cancellation period begins when the customer takes delivery. The customer must inform Sportalm in writing of the cancellation of purchase: via email: support@onlineshop.at or per post: Sportalm GesmbH, St Johanner Str. 73, A-6370, Kitzbühel. Following receipt of notification of the cancellation of purchase, Sportalm will inform the customer via email when the goods will be collected. All products must be returned by the customer in original, unused, labelled and resellable-as-new condition and in the original packaging to Sportalm. In the case of articles depreciated through signs of usage, an appropriate fee for the loss of value will be charged. This applies also in the case of returned goods which are missing parts or accessories. Upon receipt of the returned goods, Sportalm will refund the entire value of the contract within 30 days. Should the customer personally post the items and Sportalm not receive them, this cost will be covered by the customer.
Return
Retrieval of goods is provided by GLS and Sportalm will organise this on behalf of the customer. The customer is also welcome to hand over the package in person at any GLS Shop. A GLS shop search can be performed using the following GLS website. Retrieval/Return Procedure
Through using the return of goods form the customer enters the goods to be returned and gives reasons for the return of goods. We require the account details of the customer in order to refund the purchase. The invoice must still be signed. Sportalm will inform the customer via email following the successful receipt and processing of the returned goods.
Replacement
The exchange of models in another size is free of charge (when the desired size is in stock). Sportalm can only offer the customer one exchange in size. In the case that the customer wishes to exchange an article for a different design, Sportalm will place the paid invoice amount in the customer’s account as credit. The customer then purchases the new article in the online shop and the existing credit will be used against payment.
Refund upon Return
The refund will be transferred in to the customer’s account as entered on the return of goods form. There also exists the possibility to place the value of the already processed payment (after deduction of shipping costs) as credit on the customer’s Sportalm account. (please note transfer of refunds can take up to 10 working days)
Important Return and Exchange Information
Sportalm runs quality checks of all articles prior to shipping. Should the customer nevertheless receive a defective article, Sportalm must be informed immediately. Sportalm must be informed in writing within 7 days of the return of articles. All articles from the same order should be returned together. The articles must be retuned in their original packaging. The customer may return the articles using any preferred secure delivery service. Please use the following address for all returns:

In this case, please inform us via email at the following address: support@sportalm.at. When using another delivery service, Sportalm recommends their customers to take out delivery insurance due to the fact that Sportalm accepts no responsibility in this case. Returned articles must be unused, new, with original Sportalm labels attached and must be in the original Sportalm packaging. Any included garment bags must also be returned.
Damaged/Faulty Goods
If the goods become damaged or demonstrate errors in manufacturing within 6 months of receipt they will be classified as faulty. Damages caused by use will not be accepted. When the goods are faulty based on previously discussed reasons, Sportalm will provide a repair service when possible. The article may also be exchanged when in stock. In the case that neither repair or exchange are possible, the costumer will be fully refunded for the invoice amount (including delivery costs). Our contact address is: support@sportalm.at
